mondomusic enables musicians, music teachers, venues, orchestras, choirs, bands, chamber groups, businesses and music lovers to locate each other, to communicate, to post graphical, video and audio files, and to promote their skills, opportunities and activities.

When setting up a profile in mondomusic you may optionally provide information about yourself, the musical instruments you play or teach, skills, qualifications, musical preferences, engagements, date of birth and contact details, as well as any business services you offer.

Home location, name and email address are mandatory fields in mondomusic. However, your email address is never shared, and your home location is never displayed or published. Your proximity to other users is never shown as less than 100 metres.

All data, with the exception of your email address, home and current location, are otherwise publicly available to other mondomusic users.

You may also create events and include others’ events or group events in your diary.

Your diary is visible to other mondomusic users, but you may withhold details of the events you are attending by marking your attendance as private.

Limit of Liability

mondomusic is also a source of information about events scheduled at venues, such as concert halls, festivals and opera houses.

We use our best endeavours to ensure the accuracy of such information but we are unable to guarantee that all data in mondomusic are correct and up to date. We recommend that you check such information through alternative sources. In most cases we provide links to venue website.

mondomusic lists opportunities for music making, both professional and amateur. Such opportunities are obtained from public sources by mondomusic or are created by individual users and group managers.

mondomusic can provide no guarantees as to the accuracy of information listed in such opportunities or of their bona fide nature.

mondomusic lists items offered by users for sale to other users. mondomusic can provide no guarantees as to the accuracy of information listed in such items for sale, nor of the value notionally placed on them.

Any contractual liability arising from transactions between users in respect of items for sale lies entirely with the buying and selling parties, and not with mondomusic.

mondomusic lists businesses and service providers who offer goods and services that relate to music-making. Such listings are created by mondomusic from public sources or by individual users. mondomusic can provide no guarantees as to the accuracy of information listed for, or by, businesses, or of their bona fide nature. Any transactions arising between users and businesses as a result of a listing on mondomusic are entered into at the sole discretion of the parties involved (the buyer and seller), and mondomusic accepts no liability for any misinformation provided by either parties to any such transaction.

mondomusic enables users to upload static graphical files, videos and audio files, but accepts no liability for any factual claims or claims of authenticity made by a user in relation to the files he or she uploads.

mondomusic accepts no liability for breaches of copyright related to files uploaded by users, notwithstanding its obligation to provide reasonable levels of security to protect such files.

mondomusic accepts no liability for consequential damages arising from the inaccuracy of information provided by the system.

Unsuitable Content

mondomusic discourages inappropriately adverse, unfair, obscene or aggressively critical content and we reserve the right to make judgements about such content unilaterally and to remove any such material.

mondomusic reserves the right to remove opportunities, media posts, items for sale and businesses deemed, at its sole discretion, to be inappropriate.

All obscene or offensive imagery will be removed when reported or discovered.

Impersonation

mondomusic reserves the right to remove, delete or reassign users, groups, businesses and events if, solely in our judgement, we believe that unauthorised impersonation of another well-established individual, business or group has been attempted.

Inactivity

mondomusic reserves the right to delete users and associated data after 12 months of inactivity, or after a longer period, at its sole discretion.

Advice

mondomusic encourages contact between individuals who may not know each other. However, we strongly advise that when you make contact with previously unknown individuals through mondomusic, you take great care to ensure that you place yourself at no risk. We recommend that you first meet in a public place.

mondomusic accepts no liability for any adverse events arising from such meetings. We cannot guarantee the accuracy of any user’s personal data.

mondomusic does not reveal the geographical location of one user to another, though users are at liberty to reveal this information to each other through Chat.

mondomusic users should be aware of the risk of revealing their home location, by implication, through publicly visible events and group locations.

Upgrades

From time to time new versions of mondomusic are released. You may choose to upgrade mondomusic on your device. However, if you choose not to do so, you accept that in due course your version may become obsolete and that you will then have to upgrade your version of mondomusic in order to continue using the application. You will be notified in advance of this necessity.

Down Time

From time to time we may need to suspend availability of mondomusic in order to carry out maintenance work. We will endeavour to give good notice of any such suspension.

Posts

mondomusic reserves the right to remove any post it judges, unilaterally, to be in breach of copyright or to express, condone or incite prejudice related to race, religion, gender, political affiliation or sexual preference, and may also, at its sole discretion, remove posts for any reason, without explanation.

Communications

By accepting these terms and conditions you accept that mondomusic will from time to time notify you of events, opportunities and other data held in the system, as well as of news and topics related to mondomusic and of general interest to musicians and music lovers.

Reporting Users and Posts

Any user may report another user for any reason, but must provide sufficient explanation to enable mondomusic to judge, on the basis of information provided in the report and any other investigations mondomusic may choose to pursue, whether a reported user is in breach of mondomusic’s terms and conditions or has behaved in a manner incompatible with the aims of the system.

Any user may report another user’s media post or For Sale photo for any reason, such report resulting in the immediate suspension of the post or photo. mondomusic may at its sole discretion choose to reinstate the post or to remove it.

GDPR and Your Right to Privacy

mondomusic complies with the EU’s General Data Protection Regulation (GDPR).

• mondomusic is a data processor under the definitions of GDPR, except in respect of data uploaded by mondomusic administration from publicly available sources, such as venue schedules, in which case, but only in respect of such data, mondomusic is a data controller
• mondomusic takes all reasonable precautions to ensure the security of data stored in mondomusic
• mondomusic does not, without your consent, reveal personal data to other mondomusic users or third parties
• mondomusic provides you with the option to delete your account at any time. When you do so, all personal data provided by you are removed from the system
• mondomusic accepts its obligation under GDPR to report any breaches of data security to the appropriate agency
